Terms of Service

1. Agreement to Terms

By accessing or using the Jafen Media website (jafenmedia.com) or any of our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

Jafen Media provides digital marketing services including but not limited to: SEO, PPC & Paid Advertising, Web Development, Mobile App Development, Brand Strategy, and Social Media Marketing.

The specific scope, deliverables, timelines, and pricing for each engagement are outlined in a separate Service Agreement or Statement of Work (SOW) signed by both parties prior to commencement of work.

3. Client Responsibilities

To enable us to deliver services effectively, clients agree to:

• Provide timely access to required accounts, assets, and information
• Respond to queries and review requests within agreed timeframes
• Ensure all content and materials provided are owned by the client or properly licensed
• Make payments on time per the agreed schedule

4. Payment Terms

Payment terms are specified in each Service Agreement. Unless otherwise agreed:

• Invoices are due within 14 days of issue
• Late payments may incur a 2% monthly interest charge
• We reserve the right to pause services for overdue accounts

5. Intellectual Property

Upon full payment, clients own all deliverables created specifically for them (website designs, ad creatives, content, etc.). Jafen Media retains the right to display completed work in our portfolio unless the client requests otherwise in writing.

We retain ownership of all pre-existing tools, frameworks, templates, and methodologies used in the delivery of services.

6. Confidentiality

Both parties agree to keep confidential all proprietary information shared during the engagement. NDAs are available upon request and supersede this clause when signed.

7. No Guarantee of Results

While we work diligently to achieve the best possible outcomes, Jafen Media does not guarantee specific results such as search rankings, traffic levels, or revenue increases. Digital marketing results depend on many factors outside our control including market conditions, competition, and algorithm changes.

8. Limitation of Liability

To the maximum extent permitted by law, Jafen Media shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the fees paid by the client in the 3 months preceding the claim.

9. Termination

Either party may terminate a service agreement with 30 days' written notice. Work completed up to the termination date will be invoiced. Any outstanding balances remain due.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
